EB5 Visa for Nigerians: Best guide to Getting a U.S. Green Card

In this article, we will analyze one of the easiest way to get green card and permanent resident in United States as a foreigner. Follow this post till the end because in the later part we will give the simplest details on how to achieve this with the lowest capital as a Nigerian or citizen of any African country. Now, let’s start by explaining the form of visa we will be using which is EB5 Visa.

What Is an EB5 Visa? Not known by many people

For many Nigerians who dream of living, working, and building a future in the United States, obtaining a Green Card is often the ultimate goal. While most people are familiar with family sponsorship, work visas, and the Diversity Visa Lottery, relatively few understand one of the fastest legal pathways to permanent U.S. residency which is the EB5 Immigrant Investor Program.

The EB5 Visa is a U.S. immigration program created by Congress in 1990 to attract foreign investment and stimulate job creation within the American economy. Through this program, eligible foreign nationals can obtain lawful permanent residency—commonly known as a Green Card—by making a qualifying investment in a U.S. business that creates jobs for American workers. According to the U.S. Citizenship and Immigration Services (USCIS), investors, their spouses, and unmarried children under the age of 21 may qualify for permanent residence if they make the required investment and meet job-creation requirements. (USCIS)

For affluent Nigerians, entrepreneurs, business owners, and investors seeking a more direct immigration route, the EB5 visa can offer advantages that many other immigration pathways cannot.

Why the EB5 Visa Is one of the best for Nigerians

U.S. Green Card

Over the years, immigration pathways to the United States have become increasingly competitive. So, this competitiveness now makes it very hard for most African countries which Nigeria is not exceptional.

For employment-based visas, it often requires sponsorship from a U.S. employer. Going through the family-based immigration route, it can take many years depending on visa categories and country-specific demand. The Diversity Visa Lottery is not reliable because it’s completely random and offers no guarantee of selection, so I don’t think that is what you should put hope on.

The EB5 program differs because it is based primarily on investment rather than sponsorship.

Key benefits include:

  • Permanent residency for the investor
  • Green Cards for spouse and eligible children
  • Freedom to live anywhere in the United States
  • Freedom to work for any employer
  • Ability to start or acquire businesses
  • Access to U.S. educational opportunities
  • Potential pathway to U.S. citizenship after meeting residency requirements

Unlike temporary visas, the EB5 route is designed specifically to lead to permanent residency.

Why the EB5 Program was created and for who? Nigerian get way path

The U.S. Congress established the EB5 program under the Immigration Act of 1990.

The primary objectives were:

  1. Attract foreign capital to the United States
  2. Create jobs for American workers
  3. Stimulate economic development in underserved regions

Since its creation, billions of dollars have been invested into American businesses through the EB5 program, helping fund infrastructure projects, hotels, residential developments, healthcare facilities, manufacturing operations, and technology ventures. (USCIS)

In 1992, Congress introduced the Regional Center Program, allowing investors to participate in larger projects managed through USCIS-approved regional centers. This option has become one of the most common pathways used by international investors today. (USCIS)

You can see this program is not a back door or illegal means, it was created specifically for a good course to favour United States. But we Nigerians can still make use of this opportunity and get permanent residence in US.

How the EB5 Visa Leads to a Green Card

One of the best edges of the this form of visa is the fact that it is a direct part way to US green card. I believe that is the reason the EB5 program attracts global investors for the fact that its direct connection to permanent residency.

Here is a quick high light on how this Visa works, I will later explain in detailed form here is just a walk through. The process generally follows several stages, here is its highlight:

Step 1: Select an Investment Project

The investor chooses a qualifying U.S. commercial enterprise.

This could include:

  • Real estate developments
  • Infrastructure projects
  • Hospitality businesses
  • Manufacturing companies
  • Healthcare projects
  • Regional center investments

Choosing the right project is critical because the investment must satisfy USCIS requirements. I will later explain Nigerian tailored investment options which will be the safest.

Step 2: Invest the Required Capital

The investor commits the required investment amount into the project. Here is the official amount, I will explain the means to get the lowest amount later in this post.

Current investment thresholds under the EB5 Reform and Integrity Act are:

  • $800,000 in a Targeted Employment Area (TEA)
  • $1,050,000 in non-TEA locations

These thresholds are currently applicable under the reauthorized EB5 program.

Step 3: Prove the Source of Funds

One of the most important aspects of the application is demonstrating that investment funds were obtained legally.

Acceptable sources include:

  • Business profits
  • Salary income
  • Property sales
  • Stock investments
  • Gifts
  • Inheritance
  • Dividends

Investors must provide documentation tracing the funds from their source to the investment account. USCIS places significant emphasis on lawful source-of-funds evidence.

Step 4: File the EB5 Petition

After investing, the investor files the appropriate immigration petition with USCIS.

The petition demonstrates:

  • Investment eligibility
  • Source of funds
  • Business compliance
  • Job creation projections

Approval moves the investor closer to obtaining conditional permanent residency. Follow this post till the end to get the guide on how to apply and get fast approval.

Step 5: Receive Conditional Permanent Residency

Upon approval and completion of immigrant visa processing or adjustment of status, the investor and qualifying family members receive conditional Green Cards.

These Green Cards generally remain valid for two years. I will explain how to get permanent residency, and things to avoid if you need permanent residency in US after this two years.

Step 6: Remove Conditions

Near the end of the conditional residency period, investors must demonstrate that:

  • The investment remained active
  • Required jobs were created
  • Program requirements were satisfied

If approved, permanent Green Cards are granted. (USCIS)

The Job Creation Requirement

One of the foundations of the EB5 program is job creation.

Every investor must demonstrate that their investment creates or preserves at least ten full-time jobs for qualifying U.S. workers. USCIS and Congressional Research Service publications consistently identify this requirement as a core element of the program. (USCIS)

Qualifying workers generally include:

  • U.S. citizens
  • Lawful permanent residents
  • Refugees
  • Asylees

Jobs created for the investor or family members do not count toward the requirement. This is to avoid fraudulent forms of immigration, despite this I will teach how to get cheapest form of highly jobs that are qualified and meaningful. Remember, this job-creation rule ensures that the EB5 program contributes meaningfully to the U.S. economy.

Who Can Apply for an EB5 Visa?

Though there is no nationality restriction for the EB5 program, that means everyone is free to apply for this visa.

Nigerian citizens may apply provided they:

  • Meet investment requirements
  • Demonstrate lawful source of funds
  • Pass background checks
  • Meet medical examination requirements
  • Comply with immigration regulations

The program is particularly attractive to:

  • Entrepreneurs
  • Business owners
  • Real estate investors
  • High-net-worth individuals
  • Corporate executives

Advantages of the EB5 Visa for Nigerian Families

One major reason Nigerian investors pursue the EB5 route is family inclusion.

A successful application generally covers:

  • The principal investor
  • Spouse
  • Unmarried children under 21

This means an entire family can obtain permanent residency through a single investment.

Benefits include:

Access to U.S. Education

Children can attend American schools and universities.

Career Flexibility

Unlike employer-sponsored visas, Green Card holders can work for any employer.

Business Opportunities

Permanent residents may start businesses and invest freely.

Future Citizenship

After satisfying residency and naturalization requirements, investors may eventually apply for U.S. citizenship.
